الردة في قانون الأسرة الجزائري

Résumé: الملخص: ان موضوع الدراسة هو الردة وهي الخروج من الإسلام إلى الكفر وقد نص عليها المشرع الجزائري في مادة واحدة من قانون الأسرة رقم 84-11المؤرخ في 9جوان 1984وهي المادة 32فجعلها حينئذ من أسباب فسخ العلاقة الزوجية لكن بعد صدور الأمر 05-02 عدل نص المادة وتم حذف الردة كسبب من أسباب الفسخ.وحكم الردة في الشريعة الإسلامية أنها كبيرة من كبائر الإثم توجب الحد الشرعي ولديها أحكام مختلفة لذلك أحال المشرع الجزائري لأحكام الشريعة الإسلامية فيما لا يوجد فيه نص. Abstract: The subject of the study is apostasy, which is the departure from Islam to infidelity, and it was stipulated by the Algerian legislator in one article of the Family Law No. 84-11 dated June 9, 1984, which is Article 32, so he made it at that time one of the reasons for the dissolution of the marital relationship, but after the issuance of the order 05-02 the text of the article was amended and apostasy was deleted As a reason for annulment. The rule of apostasy in Islamic law is that it is a major sin that requires the legal limit and has different provisions. Therefore, the Algerian legislator referred to the provisions of Islamic Sharia in what there is no text in it.
