إشكالية إثبات الطلاق العرفي للزوج في قانون الأسرة الجزائري

Résumé: الزواج هو اللبنة الأساسية لبناء المجتمع، إذ حرس الإسلام على حماية فوضع له مجموعة من الأحكام، فجعله عقد دائم لكنه ليس أبدي، فيمكن أن ينتهي بإحدى الطريقين، الأول حتي لا سبيل لتفاديه وهو وفاة أحد الزوجين والثاني يكره ولا يحب لكنه أحد حقائق الحياة وهو الطلاق على أنواعه، والذي يهمنا في الجراسة الطلاق بإرادة الزوج. فمن خلال هذه الورقة البحثية سيتم معرفة الطلاق وأحكامه بإعتباره محوراً أساسيا في قانون الأسرة، ذو أهمية بالغة كونه يمس العلاقة الزوجية، ثم معالجة إشكالية قانونية في قانون الأسرة الجزائري رقم 84/11 المعدل والمتمم بموجب الأمر 05/02 المؤرخ في 27 فبراير 2005، وهي إشكالية الطلاق العرفي، فسيتم الكشف عن هذه الإشكالية وإعطاء الحلول لها القانونية والقضائية بما يتوافق مع أحكام الطلاق في الشريعة الإسلامية. Marriage is the basic building block of society, as Islam guarded protection and set a set of rulings for it, making it a permanent contract, but it is not eternal, so it can end in one of the two ways. Of all kinds, what interests us in the bell of divorce by the will of the husband. Through this research paper, divorce and its provisions will be known as being a fundamental axis in family law, of great importance as it affects the marital relationship, and then addressing a legal problem in the Algerian Family Law No. 84/11 amended and supplemented by Ordinance 05/02 of 27 February 2005, which is The customary divorce problem, this problem will be revealed and legal and judicial solutions to it will be given in accordance with the provisions of divorce in Islamic law.
