المحكمة الدستورية الجزائرية في التعديل الدستوري لسنة 2020: بين ضرورة التغيير وفعالية التأثير

Résumé: فرضت الظروف السياسية التي مرت بها الجزائر بعد الحراك الشعبي الذي انطلق منذ 22 فيفري 2019، إلى ضرورة إجراء تغييرات شاملة على رأسها التعديل الدستوري لسنة 2020 الذي تبنى المحكمة الدستورية عوضا عن المجلس الدستوري، والذي يعني التحول من الرقابة السياسية إلى القضائية في مجال الرقابة على دستورية القوانين. تتناول هذه الورقة البحثية مسار التغيير ودوافعه، وكذا دراسة المحكمة الدستورية كوليد جديد جاء به التعديل الدستوري الأخير، وتبحث في مدى فعالية المحكمة الدستورية، لتخلص الدراسة إلى حقيقة التغيير الذي مس اسم الجهاز فقط، فتحول من مجلس إلى محكمة مع زيادة في الصلاحيات محدودة الفعالية. The political circumstances that Algeria has experienced after the popular movement, which began since 22 February 2019, have forced sweeping changes, notably the 2020 constitutional amendment which adopted a constitutional court instead of the constitutional council. This meant a shift from political to judicial oversight in the area of oversight of the constitutionality of laws. This paper examines the course and motives of change, as well as the study of the constitutional court as a new institution in the recent constitutional amendment, and examines the effectiveness of the constitutional court. The study, concludes that the change touched only the name of the device, transformed from a council to a court with an increase of powers limited in effectiveness.
