واجبات الموظف العمومي وجزاءات الإخلال بها
Résumé: لقد تطرقنا في هذا الفصل إلى واجبات الموظف العمومي في قانون الوظيفة العمومية في الجزائر، حيث تضمن المبحث الأول من هذا الفصل الواجبات الوظيفية للموظف العمومي، ومنها واجب أداء العمل الوظيفي، واجب الطاعة في التعامل وواجب التحفظ. أما في ما يخص المبحث الثاني، تمكننا من معرفة الواجبات الأخلاقية المهنية للموظف العمومي، من بينها واجب الإخلاص والولاء والحفاظ على السر المهني، ثم واجب الاستقامة والنزاهة والمحافظة على الكرامة الوظيفية. لقد تطرقنا في هذا الفصل إلى النظام التأديبي للموظف العمومي نتيجة إخلاله بواجباتهفي قانون الوظيفة العمومية في الجزائر، حيث تضمن المبحث الأول من هذا الفصل الإطارالمفاهيمي للخطأ التأديبي، تعريف الخطأ التأديبي، ثم الإجراءات التأديبية. أما في ما يخص المبحث الثاني، تمكننا من معرفة الخطوات الإجرائية لتأديب الموظف العام والعقوبات المقررة له، وتعرفنا فيه على الخطوات الإجرائية لتأديب الموظف العام، ثمأنواع العقوبات التأديبية. Summary In this chapter, we have discussed the duties of the public servant in the public service law in Algeria. The first topic of this chapter included the job duties of the public servant, including the duty to perform the job, the duty of obedience in dealing and the duty of reservation. As for the second topic, we were able to know the professional ethical duties of the public official, including the duty of loyalty, loyalty and maintaining professional secret, then the duty of integrity, integrity and preservation of functional dignity. In this chapter, we have discussed the disciplinary system of a public official as a result of his breach of his duties in the public service law in Algeria. The first topic of this chapter included the conceptual framework of disciplinary error, the definition of disciplinary error, and then disciplinary procedures. As for the second topic, we were able to know the procedural steps for disciplining the public employee and the penalties prescribed for him, and we learned in it the procedural steps to discipline the public employee, and then the types of disciplinary sanctions
