النظام القانوني لوسيط الجمهورية في التشريع الجزائري والمقارن .

Résumé: استحدثت هيئة إدارية متخصصة أطلق عليها المشرع الجزائري اسم وسيط الجمهورية. و ذلك بموجب المرسوم الرئاسي رقم 96– 113المؤرخ في 1996/03/23المؤسس لهيئة رقابية جديدة، تمارس الرقابة الخارجية على أعمال الإدارة، و تحافظ على حريات و حقوق المواطن اتجاه سوء تسير الإدارة سواء اكانت مركزية أو لا مركزية، و المرسوم الثاني رقم 197 -96المؤرخ في 1996/05/6ا الذي حدد الوسائل المالية و البشرية و الهياكل الإدارية المخولة لهذه المؤسسة الجديدة . و بذلك يكون المشرع الجزائري قد أدخل نظاما رقابيا جديدا يساير بذلك الأنظمة الرقابية العالمية استلهمها من النموذج الفرنسي المتأثر بالنموذج السويدي ، هذا النظام الجديد استعمله لنظام الجزائري بعد التعديل الدستوري لسنة 1996 ، ليتم إلغاؤه بعد مرور ثلاث سنوات أي سنة 1999 ، ليتبناه مرة أخرى في ظل التعديل الدستوري لسنة 2016 بموجب المرسوم الرئاسي رقم 20/45 لسنة 2020 . A specialized administrative body has been created that the Algerian legislator has called the mediator of the Republic. And that is according to Presidential Decree No. 96-113 of 23/03/1996 establishing a new supervisory body, exercising external oversight of the administration’s work, and preserving citizen’s freedoms and rights toward mismanagement, whether centralized or decentralized, and second decree No. 197- 96 dated 06/06/1996, which defined the financial and human means and administrative structures empowered for this new institution . In this way, the Algerian legislator has introduced a new control system in keeping with the international control systems, which he drew on from the French model affected by the Swedish model. This new system used it for the Algerian system after the constitutional amendment of 1996, to be abolished after three years, i.e. 1999, to adopt it again in light of Constitutional amendment for the year 2016 according to Presidential Decree No. 20/45 of 2020.
