حماية المستهلك الإلكتروني في الجزائر

Résumé: عمد المشرع الجزائري إلى وضع نصوص قانونية تتعلق بحماية المستهلك في التعاقد الالكتروني، فالمستهلك يمثل الطرف الضعيف في العملية التعاقدية نظراً لتطور أنماط وحجم الاستهلاك، وبالتالي إزدياد المخاطر والانتهاكات التي تهدد أمنه وسلامته وبما أن القواعد العامة في التشريعات لم توفر الحماية الكافية للمستهلك الالكتروني، فقد اقرت التشريعات الحديثة الكثير من وسائل الحماية المدنية سواء ما قبل أو بعد التعاقد الالكتروني. وقد تم تناول في الفصل الأول إلى الإطار المفاهيمي للمستهلك التقليدي وصولاً إلى المستهلك الالكتروني، وكما تطرق عن حماية المدنية للمستهلك الالكتروني في مرحلة ما قبل التعاقد، حيث تطرقت إلى أمور حماية المستهلك وحقوقه في هذه المرحلة ومنها: كحقه بالإعلام اللاحق لإبرام العقد الالكتروني وحقه في العدول كآلية قانونية ثم تكريسها بهدف حمايته، بالإضافة غلى الحديث عن الحماية المدنية للمستهلك الالكتروني ما بعد التعاقد وذلك من خلال الإشارة إلى الالتزامات المفروضة على الطرف الأقوى اقتصاديا الذي يفرض شروطه على المستهلك الواجب حمايته. وأخيراً تم التطرق إلى الحماية الجزائية للمستهلك الالكتروني، من خلال تحديد أهم صور التجريم الماسة بالمستهلك، والتي تولها المشرع الجزائري في قواعده العامة (قانون العقوبات) أو القوانين الخاصة وتخص بالذكر قانون حماية المستهلك وقانون الممارسات التجارية وذلك بالتصدي لتلك الاعتداءات سواء بشكل وقائي أو بشكل رعي حينما تستنفذ الأفعال أثرها الإجرامي، وأيضاً تحديد الجزاءات من أجل معاقبة وردع المخالفين، وإبراز دور أهم الهيئات المخولة لها قانوناً وتوفير حماية المستهلك. - ثم انهيت بخاتمة والتي احتوت على أهم النتائج والتوصيات. الكلمات المفتاحية: المستهلك، المستهلك الالكتروني، التعاقد الالكتروني، حماية المستهلك الالكتروني، الحماية المدنية، الحماية الجزائية. Abstract : The Algerian legislator has drawn up legal texts related to consumer protection in electronic contracting, as the consumer represents the weak party in the contractual process due to the development of patterns and volume of consumption, and thus the increase in risks and violations that threaten his safety and security and since the general rules in legislation do not provide protection for the electronic consumer Modern legislation has approved many methods of civil protection, both before and after electronic contracting. The first chapter dealt with the conceptual framework of the traditional consumer down to the electronic consumer, and also dealt with civil protection for the electronic consumer in the pre-contracting stage, as it touched on matters of consumer protection and his rights at this stage, including: as his right to information subsequent to the conclusion of the electronic contract and his right to Adoption as a legal mechanism that has been established with the aim of protecting it, in addition to talking about civil protection for the electronic consumer after the contract, by referring to the obligations imposed on the economically stronger party that imposes its conditions on the consumer who must be protected. Finally, the protection of penalties for the electronic consumer was addressed, by identifying the most important forms of criminalization affecting the consumer, which the Algerian legislator undertook in its general rules (the penal code) or private laws, and in particular mentioning the Consumer Protection Law and the Commercial Practices Act, in order to address these attacks, whether in a preventive manner. Or in a deterrent manner when the acts exhausted their criminal effect, as well as determining the penalties in order to punish and deter violators, highlighting the role of the most important bodies legally authorized to them and providing consumer protection. Then I finished with a conclusion, which contained the most important findings and recommendations.
