تسيير العقار الصناعي في التشريع الجزائري

Résumé: إن استغلال وتسيير العقار الصناعي عرف تطورا تشريعيا هاما ،حيث اعتمد المشرع الجزائري بداية عقد التنازل كآلية جديدة لاستغلال العقار الصناعي ولكن تخلى عنه بعد ذلك بسبب الأضرار التي نتجت عنه، فاعتمد آلية جديدة لاستغلاله وتسييره عن طريق عقد الامتياز القابل للتنازل لكن سرعان ما تراجع المشرع الجزائري عن هذه الآلية أيضا، لتبنى عقد الامتياز بالتراضي وجعله الآلية الوحيدة التي يتم بموجبها استغلال وتسيير العقار الصناعي الموجه للاستثمار وذلك بغية وضع حد لتحويل الأراضي المخصصة لإنجاز المشاريع الاستثمارية الى اغراض أخرى غير الذي خصصت لأجلها، وبالتالي الحفاظ على الوعاء العقاري الصناعي بهدف تحقيق التنمية الاقتصادية للدولة. The exploitation and management of industrial real estate witnessed an important legislative development, as the Algerian legislator initially adopted the assignment contract as a new mechanism for exploiting industrial real estate, but then abandoned it due to the damages that resulted from it, so he adopted a new mechanism for exploiting and managing it through the transferable concession contract, but the Algerian legislator quickly retreated. From this mechanism also, to adopt the concession contract by mutual consent and make it the only mechanism by which industrial real estate intended for investment is exploited and managed, with the aim of putting an end to the transfer of lands allocated for the completion of investment projects to purposes other than those for which they were allocated, and thus preserving the industrial real estate base with the aim of achieving economic development for the state.
