Résumé: لقد حملت النصوص القانونية المختلفة المتعلقة بالعقار الصناعي أو العقار الموجه لإنجاز مشاريع استثمارية في الجزائر ، نية المشرع في تحديد طرق استغلال العقار الصناعي لكن التشريع الجزائري لم يعرف في مجال استغلال العقار الصناعي إلا في الفترة الأخيرة . ومنه فقد ظهر عقد الامتياز كإحدى الآليات الهامة في تسيير العقار الصناعي في الجزائر، قصد الانتفاع من الأراضي المتوفرة التابعة لأملاكها الخاصة لفائدة شخص طبيعي أو معنوي شريطة خضوعه لأحكام للقانون الخاص . The various legal texts relating to industrial real estate or to real estate intended for the realization of investment projects in Algeria intended the legislator to define modalities for the exploitation of industrial real estate, but Algerian legislation no was not known in the field of industrial real estate exploitation until recently. Thus, the concession contract appeared to be one of the important mechanisms in the management of industrial real estate in Algeria, in order to benefit from the available land belonging to its private property for the benefit of a natural or legal person, provided that 'it is subject to the provisions of private law.
