المسؤولية الجنائية لجراح التجميل -دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري

Résumé: تعتبر الجراحة التجميلية من النتائج التي أفرزتها التطورات العلمية الحاصلة في المجال الطبي، وهي اليوم تتجه نحو أخذ مكانة واهتمام كبيرين لدى شرائح واسعة في المجتمعات على اختلافها، إذ أنّها لم تعد مجرد ترف بل تحولت إلى ضرورة لدى الكثيرين، وعلى الرغم من أنّها تتميّز عن الجراحة العادية بعدّة مميزات، فضلا عن أنّها كانت ولازالت مثار جدل كبير، إلا أنّها شأنها شأن الجراحة التقليدية، من حيث ارتكاب الأخطاء، حيث يمكننا تصور ارتكاب جراح التجميل لأخطاء جزائية سواء أكانت عمدية أو غير عمدية، وعليه ستتناول هذه الدراسة المقارنة موقف كل من الفقه الإسلامي والقانون الجزائري من الجراحة التجميلية، ومدى تحمل جراح التجميل المسؤولية الجنائية في الفقه الإسلامي والقانون الجزائري، للوقوف على نظرة كل منهما إلى هذه الجراحة. Plastic surgery results from numerous scientific progress pertaining to the medical field, and is moving nowadays towards the acquisition of growing importance and interest among different social classes, as it is no longer considered as luxury but rather a necessity in the eyes of many, despite its particular distinction with ordinary surgery, to the extent that it has been the subject of many controversies from its appearance to nowadays. Nevertheless, its importance is not negligible when it comes to medical errors, and the plastic surgeon at fault can be subjected to criminal penalty whether they are intentional or not. Therefor , this study will address the comparative judgement of Islamic jurisprudence as well as the Algerian law regarding plastic surgery, the extent to which plastic surgeons bear criminal responsibility in both Islamic jurisprudence and Algerian law, to find out their respective views on this kind of surgery.
