المركز القانوني للوسيط في مجال تسوية النزاعات الجماعية للعمل

Résumé: الملخص: من أجل التصدي للنّزاعات الجماعية للعمل والحيلولة دون وقوع أضرار متعددة الأبعاد تطال سواء صاحب العمل جراء التوقف الجماعي عن العمل من خلال لجوء العمال إلى الإضراب، أو تطال العمال من خلال قيام المستخدم بغلق محل العمل، أو تمس الاقتصاد الوطني إذا تعلّق الأمر بنشاط حيوي أو استراتيجي، أقرّ المشرع الجزائري بموجب القانون رقم 23-08 أساليب متعددة منها وقائية وأخرى علاجية تعمل على إيجاد الحلول الودية المناسبة بعد نشوب النزاع . تعتبر الوساطة من بين الأساليب الودية الإجبارية لتسوية النزاعات الجماعية للعمل، قوامها تدخل الوسيط من أجل التقريب بين وجهات نظر طرفي النزاع واقتراح الحلول الممكنة في شكل توصيات، ونظرا للدور البارز الذي يلعبه هذا الوسيط في البحث عن أرضية توافقية بين الأطراف المتنازعة فقد تمّ تنظيم مركزه القانوني بموجب المرسوم التنفيذي رقم 23- 363 الذي حدّد فيه المنظم كيفية تعينه، المهام المنوطة به، وكيفية دفع أتعابه. Abstract : In order to confront collective labor disputes and prevent multi-dimensional damages that affect the employer as a result of a collective cessation of work through the workers resorting to a strike, or affect the workers through the employee closing the workplace, or affect the national economy if the matter is related to a vital or strategic activity. Under Law No. 23-08, the Algerian legislator approved several methods, including preventive and remedial ones that work to find appropriate amicable solutions after the outbreak of conflict. Mediation is considered one of the compulsory amicable methods for settling collective disputes. It is based on the intervention of the mediator in order to bring the viewpoints of the two parties to the conflict closer together and propose possible solutions in the form of recommendations. In view of the prominent role that the mediator plays in searching for a consensus ground between the conflicting parties, his legal status has been regulated according to Executive Decree No. 23-363 in which the regulator specified how he would be appointed, the tasks assigned to him, and how his fees would be paid.
