دور القضاء في حماية الادخار العام داخل سوق البورصة

Résumé: ملخص: تعتبر البورصة الإطار المنظم للسوق المالية والقيم المنقولة المتداولة، وقد أنشأت بغرض توفير فرص الاستثمار وكذا حماية الادخار العام، حيث أوكل المشرع مهمة تنظيم هذه السوق المالية إلى لجنة تنظيم ومراقبة عمليات البورصة باعتبارها سلطة ضبط مستقلة، ولما توفره من حماية حقيقية وجلب لرؤوس الأموال قصد استثمارها داخل السوق، غير أن الدور الرقابي الذي تتمتع به هذه اللجنة والصلاحيات الممنوحة لها من طرف المشرع لا يعفيها من خضوع أعمالها وقراراتها للرقابة القضائية، وهذا لإعطاء ضمانة أكبر لحماية الادخار العام داخل سوق البورصة، وتشجيع المستثمرين للولوج إليها بما في ذلك الشركات التجارية وحتى صغار المدخرين كالمؤسسات الصغيرة والمتوسطة. Abstract: The stock exchange is the regulated framework for the financial market and transacted values, it is established for the purpose of providing investment opportunities as well as protection of public savings, where the legislator attached to the organization of this financial market to the Regulation and Control Committee, which provide real protection and bring share capital to invest it in the market. However, the supervisory role of this Committee does not exempt their actions and decisions to be submitted to judicial control, and in order to give it more guarantees and insurances to protect the public savings in the stock exchange market, and to encourage investors to access the stock exchange market, including commercial companies and even small savers as small and medium enterprise.
