رقابة القضاء الإداري على عمليات التنازل عن المؤسسة العمومية الإقتصادية في السوق المالية Administrative Judicial Control Of The Economic Public Company Missions On The Financial Market

Résumé: ملخص: تهدف هذه الدراسة إلى تبيان دور القضاء الإداري في حماية المال العام للدولة من خلال الرقابة التي يمارسها بمناسبة التنازل عن المؤسسة العمومية الإقتصادية داخل السوق المالية، التي تعد كمرحلة ثانية بعد تقييم المؤسسة المراد خوصصتها، وتحديداً رقابة مشروعية قرارات لجنة تنظيم ومراقبة عمليات البورصة، التي تخضع تطبيقاً للمعيار العضوي لرقابة القضاء الإداري بإعتبارها سلطة إدارية وهي من بين الهيئات العمومية الوطنية. Abstract: This study aims to clarify the role of the administrative judicial in the protection of the public funds of the State through the control which he exercises at the time of the transfer of the public economic institution within the financial market, which is considered as a second step after evaluation of the institution to be privatized, in particular the control of the legitimacy of the decisions of the committee for regulation and monitoring of stock market operations, which are subject to In application of the organic standard for the control of the administrative judicial power as an administrative authority and it is part of national public bodies.
