الجرائم الأخلاقية الواقعة على نظام الأسرة في ظل التعديلات الجديدة في القانون الجزائري

Résumé: تعتبر الجرائم الأخلاقية أخطر أنواع العنف الأسري وأبشع جرائم الاعتداء على الاخلاق كونها من الأفعال الشنيعة التي تخدش شرف وعرض الانسان وتشكل تهديدا كبيرا على جسمه وحريته الجنسية، بحيث تعد الجرائم التي تقع على الأسرة من قبل أفرادها أشد خطورة من تلك التي تقع عليها من خارج أفرادها، باعتبار أن المجني عليه يشعر بالأمان والطمأنينة لأنه يقيم مع الجاني. وهذه الجرائم الأخلاقية قد تقوم على المواقعة الجنسية التامة كالاغتصاب والزنا والفاحشة بين ذوي المحارم، كما قد تتم بدون فعل الوطء الطبيعي كالتحرش الجنسي والفعل العلني المخل بالحياء والفعل المخل بالحياء، إلا أن الجامع بينهم دائما عدم رضا الضحية ما عدا الزنا التي تتم برضا الطرفين قصد اشباع الرغبة الجنسية. وباعتبار أن هذه الجرائم تمس بكيان الأسرة ومقوماتها فقد حرص المشرع الجزائري على صيانة العرض من خلال وضع نصوص عديدة تكفل حمايته عن طريق تجريم الأفعال والتصرفات التي تمثل عدوان على الحرية الجنسية. These moral crimes may be based on complete sexual intercourse, such as rape, adultery, and outrage between the incest, and may also take place without the act of sexual intercourse, such as sexual harassment, the public act that violates modesty, and the act that violates modesty, except that the combination of them is always the lack of consent of the victim except for adultery that is done with the consent of both parties in order to satisfy concupiscence. Considering that these crimes affect the family’s structure and its components, the Algerian legislator was keen to maintain the show by developing several texts that guarantee its protection by criminalizing acts and behaviors that represent an attack on sexual freedom..
