الطابع الوقائي للتشريع الجزائري لحماية الطفولة من مخاطر الأنترنت

Résumé: مع التطور التكنولوجي و ظهور شبكة الإنترنت بدأت تظهر بوادر الاستعمال السلبي لهذه الأخيرة و ازدياد مخاطرها خاصة على فئة الأطفال الضعيفة، و ظهر ظاهرة الاستغلال الجنسي لهم عبر هذه التكنولوجيا، حظي الموضوع باهتمام المجتمع الدولي و ذلك بغية القضاء على الأثار السلبية لهذه الظاهرة بهدف الحفاظ على الأجيال المستقبلية، والجزائر كغيرها من الدول عمدت على سن الترسانة القانونية التي تكرس الحماية التشريعية لهذه الفئة من مخاطر الإنترنت عموما و الإستغلال الجنسي خصوصا. حيث حظيت هذه الفئة في الجزائر بنص حمائي متميز من خلال اصدار القانون 15-12 المتعلق بحماية الطفل ، بغية ردع الأعمال الاجرامية الماسة بهذه الفئة و وضع الآليات الوقائية اللازمة لذلك . الكلمات المفتاحية : الطفل ، الإنترنت ، المخاطر ، الحماية القانونية ، الحماية التقنية . Abstract : With the development technology and the emergence of the internet , there are beginning to show signs of negative use of the latter and their increased risks , especially to the category children . And the phenomenon of sexual exploitation of them has emerged through this technology . The topic has received the attention of the international community in order to eliminate the negative effects of this phenomenon in order to preserve future generations . Algeria , like other states , has enacted a legal arsenal that enshrines legislative protection for this category of internet risk in general and sexual exploitation in particular . In Algeria , this group has been given a distinct protective text through the promulgation of law 15-12 on child protection , with a view to deterring the criminal acts in this category and establishing the necessary preventive mechanisms .
