نظام الحصانة الدستورية و الإمتياز القضائي ومبدأ المساواة أمام القانون .

Résumé: الملخص باللغة العربية:يهدف هذا المقال البحثي إلى دراسة موضوع نظام الحصانة الدستورية ومبدأ الامتياز القضائي القانوني في ضوء التعديلات التي عرفها الدستور الجزائري و قانون الإجراءات الجزائية لسنة 2020، وذلك من منظور الإجراءات والمسؤولية الجزائية للأشخاص المتمتعة بالحصانة والأشخاص المستفيدين من امتياز التقاضي المنتمين للسلطة التنفيذية والتشريعية و القضائية. ضمن إشكالية قانونية تتناول النطاق الشخصي والموضوعي لنظام الحصانة والامتياز القضائي، ومدى تكريس مبدأ المساواة أمام القانون و تحقيق التوازن بين متطلبات الفعالية والحماية الوظيفية، وبين ما تفرضه من متابعة وملاحقة كل من ارتكب جريمة و أخل بنظام المجتمع ومن ثم توقيع الجزاء الجنائي عليه. ABSTRACT This research article aims to study the issue of the constitutional immunity system and the principle of legal judicial privilege in light of the amendments introduced in the Algerian constitution and the Algerian Criminal Procedure law in2020. This is with respect to procedures and criminal responsibility of persons enjoying immunity and persons benefiting from the judicial privilege belonging to the executive, legislative and judiciary authority . The legal problem of this study will focus on the personal and the substantive scope of the system of immunity and judicial privilege, and the extent to which the principle of equality before the law is enshrined. In addition, achieving a balance between the requirements of effectiveness and functional protection , and between the requirements of criminal justice and its imposition of pursuing and prosecuting everyone who commits a crime and breaches the social order, and then inflicts the criminal penalty on him.
