دور التشريعات في تحقيق التنمية المستدامة في ضوء رؤية سلطنة عمان 2040 قانون العمل العماني رقم 53 / 2023 إنموذجاً

Résumé: تُسلط الدِراسة الضوء على دور التشريع في تعزيز التنمية المستدامة، تناولت قانون العمل العُماني رقم 53 لسنة 2023 كنموذج تطبيقي على تعزيز تلك الأدوار في رؤية سلطنة عُمان 2040 أو من خلال تمكِين التنمية المستدامة خصوصا في بعدها الإقتصادي والجانب الإجتماعي، ولغاية تحقيق أهداف الدراسة تم تقسيمها الى مبحثين وستةِ مطالب على النحو الاتي: ركز المبحث الأول الضوء على الإطار المفاهيمي للدراسة من حيث تعريف المصطلحات الرئيسية مثل قانون العمل والتنمية المستدامة ومفهوم رُؤية سلطنة عُمان 2040، أما ألمبحث الثاني فقط سلط الضوء على دور التشريع في تحقيق التنمية المستدامة وتمكين رؤية سلطنة عُمان 2040على النحو التالي: تناول المطلب الأول. دور التشريعات في تحقيق التنمية المستدامة، المطلب الثاني تناول دور رؤية عُمان 2040في تمكين التشريعات الخاصة بسوق العمل، أما المطلب الثالث فتناول دور قانون العمل العماني في تعزيز التنمية وتحقيق رؤية سلطنة عُمان، خَلُصت الدِراسة الى عددٍ من النتائج منها أن تحقق التنمية المستدامة يرتبط إرتباطاً وثيقا بمواكبة التشريعات وتمكينها بالإضافة الى ضرورة توفير البنى الأساسية للشراكة بين القطاعين الحكومي والخاص؛أوصت ببعض التوصيات منها على سبيل المثال ضرورة إستمرار تحديث قانون العمل العماني بشكل دوري بما يضمن مواكبته لمتطلبات ومتغيرات التنمية المستدامة، بالإضافة الى ضرورة أن تحتوي مساعي تطوير قانون العمل في المستقل على كل ما من شانه إعادة تشكيل الحوافز التجارية لتشجيع الاستثمارات طويلة الأجل والبحث العلمي فيما يتعلق بتطوير وتحسين بيئة العمل. الكلمات المفتاحية: قانون لعمل، التنمية المُستدامة، الرؤية، التشريع Abstract: - The study sheds light on the role of legislation in promoting sustainable development, it dealt with the Omani Labor Law No. 53 of 2023 as an applied model to enhance those roles in the vision of the Sultanate of Oman 2040 or by enabling sustainable development, especially in its economic dimension and the social aspect, and in order to achieve the objectives of the study, it was divided into two sections and six demands as follows: The first section focused on the conceptual framework of the study in terms of defining key terms such as labor law, sustainable development and the concept of the Sultanate's vision. Oman 2040.The second topic only highlighted the role of legislation in achieving sustainable development and enabling the vision of the Sultanate of Oman 2040 as follows: Addressing the first requirement. The role of legislation in achieving sustainable development, the second requirement dealt with the role of Oman Vision 2040 in enabling legislation on the labor market, while the third requirement dealt with the role of the Omani labor law in promoting development and achieving the vision of the Sultanate of Oman, the study concluded a number of results, including that achieving sustainable development is closely related to keeping pace with legislation and enabling it, in addition to the need to provide infrastructure .It recommended some recommendations, including, for example, the need to continue updating the Omani labor law periodically to ensure that it keeps pace with the requirements and variables of sustainable development, in addition to the need for efforts to develop the labor law in the independent to contain everything that would reshape commercial incentives to encourage long-term investments and scientific research with regard to the development and improvement of the work environment.
