الأسس الدستورية لحالة الطوارئ الصحية في الجزائر بين النص القانوني والممارسة - آفاق المستقبل

Résumé: ملخص: شكّل وباء فيروس كورونا (كوفيد-19) تهديدا خطيرا للصحة العامة وحياة الأفراد على المستويين العالمي والوطني. يهدف المقال إلى مناقشة طبيعة النصوص التي صدرت عن السلطات العامة في الجزائر لمواجهة الوباء، وبيان الأسس الدستورية للتدابير المتخذة للوقاية من انتشاره ومكافحته. يتبيّن من بعض الأحكام المقيدة للحقوق والحريات الفردية والجماعية أننا أمام حالة طوارئ صحية غير معلنة بشكل رسمي، لسد فراغ في المنظومة القانونية الصحية التي تتطلب إضافة حالة استثنائية جديدة في المستقبل. Abstract: The Coronavirus (COVID-19) epidemic poses a serious threat to public health and the lives of individuals at the global and national levels. The article aims to discuss the nature of the texts issued by the public authorities in Algeria to confront the epidemic, and to explain the constitutional basis for the measures taken to prevent and combat against its spread. It is evident from certain provisions restricting individual and collective rights and freedoms that we are facing an unofficially declared health emergency, to fill a void in the health legal system that requires the addition of a new exceptional case in the future.
