جرائم الإشهار الإلكتروني في التشريع الجزائري
Résumé: إن دراسة إشكالية مدى فاعلية التشريعات الجزائية في حماية المستهلك من الإشهار التجاري الغير مشروع في التعاملات الإلكترونية؟، قادتنا إلى تحليل نصوص مواد القانون رقم 18-05 المتعلق بالتجارة الإلكترونية، حيث حاولنا الإجابة عن هذه الإشكالية بالإعتماد على المنهج التحليلي في تحليل نصوص القانون 18-05، بالإضافة إلى الاعتماد على المنهج الوصفي. ومن أهم النتائج التي توصلنا إليها في هذه الدراسة، هي تبني المشرع الجزائري لسياسة ردعية تجاه عملية الإشهار الغير مشروع وذلك من خلال فرض عقوبات جزائية ضد المخالفين. A problematic study of the effectiveness of penal legislation in protecting the consumer from unlawful commercial advertising in e- transactions ?, It led us to analyze the provisions of Law No. 18-05 related to e-commerce, We tried to answer this problematic by relying on the analytical approach of the provisions of Law 18-05, in addition to the descriptive approach. Among the most important results that we reached in this study, is the adoption of a deterrent policy towards the process of illegal advertisement by the Algerian legislator, through the imposition of penal sanctions against violators.
