التقادم الجزائي في جرائم الفساد

Résumé: تبحث هذه الدراسة مشكلة تطبيق مبدأ التقادم في جرائم الفساد وما يترتب عليه من أثار، تصدر البحث مقدمة تناولت إشكاليته وأهميته والمنهجية المتبعة فيه، وقد تم تقسيم الدراسة إلى مبحثين، الأول تناول ماهية مبدأ التقادم، والمبحث الثاني تم تخصيصه لموقف المشرع الجزائري ،وكذا تقديم مبررات استبعاد تطبيق هذا المبدأ على جرائم الفساد،وقد خلصت الدراسة إلى مجموعة من النتائج أبرزها تبني المشرع الجزائري لمنهجا خاصا بهذا الشأن، وانتهت الدراسة إلى توصية بضرورة استبعاد تطبيق التقادم الجزائي على جرائم الفساد بصورة مطلقة This study examines the issue of applying the statute of limitations in corruption crimes and its consequences. The introduction of the study dealt with the problems arising from the statute of limitations and its importance. It also mentioned the methodology followed in this study. The research was divided into two topics, the first one dealt with the nature of the statute of limitations and the second topic addressed the position of the Algerian legislator as well as providing justifications for excluding the application of this principle on corruption crimes. The study was concluded with a set of results, the most prominent one is the adoption of the Algerian legislature to a special approach in this regard. It also provided a recommendation that the application of criminal statute of limitations on corruption crimes should be excluded altogether.
