التقَادمُ المُسقِطُ للدَعوَى والشَّهَادَة في القضاء

Résumé: نشأت فكرة التقادم وترعرعت في الفقه الإسلامي، وأخذت مجلة الأحكام العدلية بها، ومن الفقه الإسلامي استمد القانون المدني انقضاء الالتزام دون الوفاء به بالتقادم المسقِط، وتوسَّع فيها، وفي هذا البحث بينت تعريف التقادم كما ورد في الفقه الإسلامي والقانون الوضعي، والواجبات التي تسقط بالتقادم، ثم بينت في المبحث الأول تقادم الدعوى فبينت أن محل التقادم في الدعوى في الحقوق الواجبة للعباد وأنه لا يسري على الحقوق العامة وأنَّ أثر التقادم قضائي لا دياني، ومدة التقادم وموانع الأخذ به، ثم بينت في المبحث الثاني تقادم الشهادة فبينت فيه محل التقادم في الشهادة وأنَّه في الجناية التي هي حق لله تعالى، وبينت مدة التقادم في الشهادة في جرائم الزنا والسرقة والشرب، ثمَّ ختمت بأهمِّ النتائج والتوصيات التي توصلت إليها. Abstract: The idea of statute of limitations originated and was nurtured in Islamic jurisprudence, and the Journal of Judicial Judgments took it, and from Islamic jurisprudence the civil law derives the expiry of the obligation without fulfilling it by the dropped statute of limitations, and it has expanded in it. Then she explained in the first section the statute of limitations in the case, which indicated that the place of limitation in the case is in the rights that are due to people and that it does not apply to public rights and that the effect of prescription is judicial, not religious, the period of prescription and the impediments to its adoption. In the felony, which is the right of God Almighty, and indicated the limitation period for testimony in the crimes of adultery, theft and drinking, then concluded with the most important findings and recommendations it reached.
