التحفظات على اتفاقيات حقوق الإنسان Reservations To Human Rights Treaties

Résumé: تتميز الحقوق الأساسية الواردة في الشرعة الدولية لحقوق الإنسان بالعالمية، إلا أنها تعتبر المجال الأبرز للتحفظات، ويرجع ذلك لضرورة الموازنة بين سيادة الدولة وخصوصيتها وبين التزاماتها الدولية، ومع ما تمتاز به حقوق الإنسان من تكامل وترابط، يطرح تطبيق أحكام اتفاقية فيينا لقانون المعاهدات على اتفاقيات حقوق الإنسان إشكاليات كثيرة، لانعدام المعاملة بالمثل في اتفاقيات حقوق الإنسان التي يجب حمايتها وتعزيزها بغض النظر عن الخلفيات الدينية والثقافية والسياسية. وهو موضوع عالجته آليات حقوق الإنسان التي اتفقت اجتهاداتها القضائية على ضرورة مراعاة خصوصية التحفظات على حقوق الإنسان، حيث توصلنا إلى أنه رغم عالمية حقوق الإنسان وخصوصياتها وتميزها عن غيرها من الالتزامات التي ترتبها عن غيرها من الاتفاقيات الدولية ما يجعل تطبيق اتفاقية أحكام التحفظات الواردة في اتفاقية فينا لقانون المعاهدات محل خلاف. The fundamental rights contained in the International Bill of Human Rights are characterized by universality, but they are considered the most prominent area of reservations, due to the need to balance the state’s sovereignty and its specificity with its international obligations. With the complementarity and interdependence of human rights, the application of the provisions of the Vienna Convention on the Law of Treaties to human rights conventions poses many problems, due to the lack of reciprocity in the human rights conventions, which must be protected and promoted regardless of religious, cultural and political backgrounds It is a topic that has been addressed by human rights mechanisms whose jurisprudence has agreed on the need to take into account the specificity of reservations to human rights
