السندات التنفيذية الأجنبية في قانون الإجراءات المدنية والإدارية الجزائري
Résumé: إن تنفيذ السندات الأجنبية من أهم مواضيع القانون الدولي الخاص، ولذلك عمد المشرع الجزائري عند تنظيمه لهذا الموضوع الى التوفيق بين مبدأين، الأول يتعلق بمصالح الأفراد، والثاني ينبثق من مبدأ سيادة الدولة. وتجسيدًا لهذه الموازنة تدخل قانون الإجراءات المدنية والإدارية بنصوص تضمنت فحواها الإقرار بتنفيذ السندات الأجنبية القضائية منها وغير القضائية بشروط وضوابط متماشية مع النصوص الدولية في هذا المجال. The implementation of foreign bonds is one of the most important topics of private international law. Therefore, the Algerian legislator, when organizing this issue, reconciled two principles, the first concerns the interests of individuals and the second emanates from the principle of state sovereignty. Judicial and non-judicial conditions and controls consistent with international texts in this area.
