الوضعية التشريعية لمواجهة جرائم الإتجار بالبشر في الدول العربية

Résumé: بما أن أغلب الدول العربية قد صادقت على التشريعات الدولية الأساسية لحقوق الإنسان، وأيضا تلك الخاصة بالإتجار بالبشر وغيرها، كان على الدول العربية أن تنحو منحى نظيراتها من الدول وتطابق تشريعاتها الوطنية مع التزاماتها الدولية لا سيما في مسألة مكافحة الإتجار بالأشخاص. وعليه قامت الدول العربية بجهود قانونية وطنية من أجل مكافحة الإتجار بالبشر على المستوى التشريعي فنجد حظر وتجريم الإتجار بالبشر بشكل عام، أو إحدى أو بعض صوره في مراكز مختلفة من الهرم التشريعي في الدولة ومحاولة مطابقة هذا التجريم والحظر مع النموذج الدولي لتجريم الإتجار بالأشخاص، باعتباره نموذجا متفقا عليه ولاقى إجماعا دوليا، حتى تصل بتشريعاتها إلى أقصى حد ممكن من الشمول. الكلمات المفتاحية: الدول العربية، الإتجار بالبشر، التجريم، المكافحة، التشريع. Summary : Since most of the Arab countries have ratified the basic international human rights legislation, as well as those related to human trafficking and others, the Arab countries had to follow the path of their counterparts and conform their national legislation with their international obligations, especially in the issue of combating trafficking in persons. Accordingly, the Arab countries have made national legal efforts to combat human trafficking at the legislative level. We find the prohibition and criminalization of human trafficking in general, or one or some of its forms in different centers of the legislative hierarchy in the country and an attempt to match this criminalization and prohibition with the international model for criminalizing trafficking in persons, as a model Agreed upon and met with an international consensus, in order to reach its legislation as comprehensive as possible. key words: Arab countries, Trafficking in Human Beings, incrimination, fight, legislation.
