الآراء الأصولية للإمام الباجي من خلال كتابه " إحكام الفصول في أحكام الأصول "-الأدلة المختلف فيها أنموذجا -

Résumé: يتعلق موضوع رسالتنا ىذه بالآراء الأصولية للإمام الباجي التي ضمنها في كتابه الأصولي إحكام الفصول في أحكام الأصول ، وقد تركز اختيارنا على آرائو التي ذىب إليها في مسائل الأدلة المختلف فيها، ومن ثمّ حاولنا في البداية أن نقف على المدونة الأصولية المختارة لبحثنا، ونتعرف على صاحبها، وقد تم من خلال كل ذلك بيان منهجو الأصولي، وذكر اسهاماتو الواضحة في علم أصول الفقو ، ومن تلك الإسهامات ما يتعلق بالأدلة المختلف فيها، وعليو انصب اىتمام ىذا البحث في بيان وجمع وإبراز آراء الباجي الأصولية في ىذه الأدلة و التي منها عمل أىل المدينة ، والاستحسان ، وسد الذرائع ، والاستصحاب ، والأخذ بأقل ما قيل، وجملة ىذه المسائل التي تناولها البحث انتهجنا في طريقة عرضها التعريف بالمسألة، وبعد ذلك ذكر محل النزاع فيها مع الآراء التي قيلت فيها، لنصل بعدىا للرأي الذي اختاره الإمام الباجي فيها، مع ذكر الأدلة التي استند عليها لإبراز ىذا الرأي والرد عليو ، ثم نختم ذلك بمثال تببيقي على كل المسألة من المسائل المعروضة. :The theme of our study is aboute fundamentalist imam Albaji that including on his book fundamentalist tightening chapters in the tightening of assets, focused our choice on his views that he went to in contentious evidence issues, and then we tried at first to stand on the fundamentalist code selected for our research, and identify the owner, has been mentioned during all of this statement method fundamentalist, said his contributions with regard to the evidence and from which the work of the people of the city, and the plaudits and excuses ,immanence and taking less what was said, and the campaign of these issues addressed by the research included in the presentation definition question, and then stated in dispute chosen by Imam Albaji , with the evidence tpresentedhat was based on it to highlight this view and respond to it and then conclude that the example applied to each of the issues
