الإطار القانوني لاستثمار الأراضي الفلاحية الوقفية في التشريع الجزائري

Résumé: الملخص: يهدف هذا المقال إلى تسليط الضوء على موضوع استثمار الأراضي الفلاحية الوقفية وفق أحكام القانون رقم 91-10 المتعلق بالأوقاف (المعدل والمتمم) وكذا بعض النصوص الخاصة في هذا المجال، حيث نص المشرع الجزائري بموجب هذه النصوص على صيغ استثمارية تتناسب وطبيعة الأرض الفلاحية الوقفية، وذلك من أجل تنميتها وتحقيق المقاصد الشرعية التي أوقفت من أجلها، وبالتالي تحقيق النفع العام للمجتمع ودفع عجلة تنميته في جميع المجالات. وعليه سنتناول الإطار القانوني لاستثمار الأراضي الفلاحية الوقفية من خلال التطرق للعقود التي نظمها المشرع الجزائري في هذا الصدد، حيث نص على أغلب هذه العقود في آخر تعديل لقانون الأوقاف، وذلك بموجب القانون رقم 01-07 المؤرخ في 22/05/2001. Abstract: This article aims to shed light on the issue of agricultural wakf lands investment in accordance with the provisions of Law No. 91-10 related to endowments (amended and supplemented) as well as some special texts, where the Algerian legislator has stipulated investment formulas commensurate with the nature of these lands, in order to develop them and achieve their goals, Thus achieving the public benefit for society and achieving development in all fields. Accordingly, we will deal with the legal framework for the investment of these lands by addressing the contracts organized by the Algerian legislator in this regard, which were dealt with in the latest amendment of the Endowment Law according to Law No. 01-07 of 22/05/2001.
