النظام القانوني لعقد إيجار الأراضي الوقفية الفلاحية في التشريع الجزائري
Résumé: بصدور القانون 01-07 المتضمن تعديل القانون 91-10 المتضمن الأملاك الوقفية أسس المشرع لآليات جديدة لاستثمار الأراضي الوقفية الفلاحية ولعل أهمها إمكانية تأجيرها من قبل الهيئة المكلفة بالأوقاف، غير أنه لم يحدد شروط وكيفيات ذلك إلى غاية صدور المرسوم التنفيذي 14-70 الذي حدد شروط وكيفيات إبرام عقود إيجار الأراضي الوقفية الفلاحية، كم تم وضع آليات لتسوية وضعية الأراضي المسترجعة من الدولة والتي سبق منحها للمستثمرات الفلاحية وذلك بتحويل حق الانتفاع الدائم أو حق الامتياز الممنوح لها إلى عقد إيجار وفقا لشروط محددة. With the promulgation of the law 01-07 amending the law 91-10 wearing the wakfs property, the legislator has established a new mechanisms for the exploitation of land of wakf land intended for agriculture, and the most important is the possibility of renting them by the institution in charge of wakfs, but he did not designate the terms and conditions of this rental until the promulgation of Executive Decree 14-70 laying down the terms and conditions for concluding deeds of rental of agricultural land from wakf, as mechanisms have been put in place to regularize the situation of land reclaimed by the State, and which have been allocated to agricultural holdings by modifying the right of permanent enjoyment or the right of concession to a rental deed according to certain conditions.
