المضاربة غير المشروعة وآليات مكافحتها في إطار القانون 21-15

Résumé: ألقت جائحة كورونا بظلالها على وضعية الاقتصاد الوطني، مما أسهم في انتشار ظاهرة المضاربة غير المشروعة التي أصبحت تمس بأمن واستقرار المجتمع، وفي ظل وجود ترسانة قانونية غير كافية للحد من هذه الجريمة كان لزاما على المشرع الجزائري التدخل فاستحدث القانون 21-15 المتعلق بمكافحة المضاربة غير المشروعة، الذي حمل في طياته مجموعة من الأحكام الوقائية والجزائية والآليات لمواجهة هذه الظاهرة وردع مرتكبيها من خلال تجريم الأفعال التي تشكل مضاربة غير مشروعة، بهدف حماية الحقوق الإقتصادية للمستهلك من جهة، وتدعيم نظام مراقبة السوق الوطنية من جهة أخرى. The Corona pandemic cast a shadow over the state of the national economy, which contributed to the spread of the phenomenon of illegal speculation, which has come to affect the security and stability of society. Lawful, which carries with it a set of preventive and penal provisions and mechanisms to confront this phenomenon and deter its perpetrators by criminalizing acts that constitute illegal speculation, with the aim of protecting the economic rights of the consumer on the one hand, and strengthening the national market control system on the other hand.
