مدى مسؤولية الطبيب الجراح عن أخطاء مساعديه في المستشفيات العامة

Résumé: ملخص: يعتبر الطبيب الجراح سيد الفريق الطبي، باعتباره المتدخل المباشر في جميع مراحل العلاج، إلا أن دوره تقلص بظهور تخصصات جديدة، ورغم عمل الطبيب الجراح ضمن فريق من المتخصصين كل في مجال تخصصه، من أخصائيين ومساعدين إلا أن تدخل هؤلاء يكون ضمن ما يرسمه لهم من حدود، وهو من يتولى الإدارة والمراقبة، الأمر الذي يثير التساؤل حول المسؤولية الناجمة عن هذا التدخل، ذلك أن مكمن الصعوبة يبدو في استعانة الطبيب الجراح الرئيسي بأطباء مساعدين له كاستعانته بطبيب التخدير وطبيب الأشعة وطبيب التحاليل، مما يصعب معه تحديد دائرة الخطأ نتيجة هذا العمل ذي الصفة الجماعية، وهو ما حفز ازدياد حالات المسؤولية داخل الفريق الطبي، فالطبيب يسأل عن الخطأ الصادر من مساعديه باعتباره متبوعا، فالطبيب يعتبر متبوعا عرضيا من المساعد الذي صدر عنه الخطأ، ومفاد هذه العرضية أن الطبيب مكلف برقابة مساعديه وتوجيههم أثناء أداءهم لمهامهم، وبمجرد انتفاء سلطة الرقابة والتوجيه والإشراف عادت تبعية هؤلاء المساعدين إلى المستشفى العام باعتباره المتبوع الأصلي. Abstract: The surgeon is considered the leader of the medical team, with regard of his field of expertise, since he’s the one whointervenes directly during all stages of the treatment. The surgeon intervenes with a team of specialists and assistants, but it is him who determines the margin of intervention of each of them, under his direction and supervision. This raises questions about the responsibility that results from this intervention. The difficulty lies in the surgeon’s request for assistance of the anesthesiologist, the radiologist, the laboratory technician, which makes it difficult to determine the scope of liability of each for the possible damages caused to the patient. This group work has given rise to the cases of liability within the medical team. Thus, the surgeon, as principal, is secondarily responsible for the fault committed by his assistants. However,the surgeon’s liability for the faults of his assistants, arises from his power of supervision, guidance and oversight onthem during the performance of their missions, and as soon as this bond ceases to exist, the responsibility is shoulderedby the public hospital, being the original principal.
