الحصانات والامتيازات الدبلوماسية والقنصلية

Résumé: تعتبر الحصانة الدبلوماسية نوع من الحصانة القانونية وسياسة متبعة بين الحكومات، تضمن عدم ملاحقة ومحاكمة الدبلوماسيين تحت طائلة قوانين الدولة المضيفة، وقد تم الاتفاق على الحصانة الدبلوماسية كقانون دولي في مؤتمر فيينا للعلاقات الدبلوماسية الذي عقد في 1961، وعليه سنتطرق في هذه الورقة البحثية الى لمحة سريعة على الأساس النظري الذي تستند إليه الحصانات والامتيازات الدبلوماسية وبيان الوضع المتميز لمقر البعثة وما يتمتع به من حماية تجعله ليس كبقية الأبنية التابعة للدولة وحرمته واهم الامتيازات التي يحصل عليها هدا البناء، مع تحديد مضمون وماهية الحصانات التي يتمتع بها أعضاء البعثة وعائلاتهم ونطاق تمتع كل واحد منهم بهذه الحصانة، كما سنتعرض إلىتطبيق عملي لأحكام العلاقات الدبلوماسية مبرزين بداية تمتع القناصلة بالحصانة والامتيازات وبيان نوعية الحصانة التي كفلها القانون الدولي لمقر البعثة، مع تحديد مضمون وماهية الحصانات التي يتمتع بها القناصلة العاديون والقناصلة الفخريون ونوع الامتيازات التي يحوزها كل واحد منهم وعائلاتهم ونطاق تمتع كل واحد منهم بهذه الحصانة والامتيازات. وفي الاخير سنحاول ان نشرح أوجه الشبه والاختلاف بين الحصانة الممنوحة لمقر البعثة الدبلوماسية من جهة والقنصلية من جهة أخرى، معتطبيق عملي لأحكام العلاقات القنصلية . Abstract Diplomatic immunity is a form of legal immunity that ensures diplomats are given safe passage and are considered not susceptible to lawsuit or prosecution under the host country's laws, although they can still be expelled. Modern diplomatic immunity was codified as international law in the Vienna Convention on Diplomatic Relations (1961) This paper gives an overview on the theoretical basis of diplomatic immunities and privileges as well as the special status, protection and inviolability granted to the premises of diplomatic missions. Furthermore, it describes the immunities enjoyed by members of the mission and their families and discusses the application of the provisions of diplomatic relations and the caseof the armed attack on the United States Embassy in Tehran, the opinion and decisions of the International Court of Justice then. This paper also provides an overview on consular immunity andtypes of immunity granted by international law to the premises of the mission, the scope and nature of privileges and immunities enjoyed by ordinary and honorary consuls and their families. Similarities and differences between the immunity accorded to diplomatic mission premises and the immunity accorded to consular premises
