حدود اختصاصات رئيس الدولة في الظروف العادية في ظل التعديل الدستوري 2016

Résumé: ملخص: من منطلق ضمان مبدأ استمرارية الدولة واستقرار مؤسساتها الدستورية يمارس رئيس الدولة -بعد إعلان حالة الشغور النهائي لمنصب رئيس الجمهورية- جملة من الاختصاصات في الظروف العادية باعتباره رئيسا لسلطة التنفيذية. وقد تم تحديد صلاحيات رئيس الدولة بطريقة سلبية طبقا لأحكام المادة 104 من التعديل الدستوري 2016، حيث ما يخرج عن مجال هذه المادة يدخل في جملة اختصاصه. Abstract In light of the principle of the continuity of the state and the stability of its constitutional institutions, the President of the State, after declaring the final vacancy for the post of President of the Republic, exercises a number of competencies in ordinary circumstances as the head of the Executive Authority. The powers of the Head of State have been determined in a negative manner in accordance with the provisions of Article 104 of the Constitutional Amendment 2016,where what goes beyond the scope of this article falls within the scope of its jurisdiction.
