اختصاصات المحكمة الدستورية في ظل التعديل الدستوري 2020

Résumé: استحدث المؤسس الدستوري الدستوري الجزائري في التعديل الدستوري 2020 هيئة دستوريو جديدة تتمثل المحكمة الدستورية بدلا من المجلس الدستوري الذي كان مكرسا ابتداءً من دستور 1989 ، وتهدف هذه الدراسة إلى إبراز اختصاصات الهيئة الدستورية الجديدة مقارنة بالمجلس الدستوري هل احتفظ بنفس الاختصاصات أم خولها اختصاصات جديدة، وتوصلنا من خلال هذا البحث إلى مجموعة من النتائج من بينها تخويل المحكمة الدستورية اختصاص جديد لم يكن مسند للمحكمة الدستورية و المتمثل في الفصل في الخلافات بين السلط العليا في الدولة و رفع الحصانة البرلمانية عن أعضاء البرلمان .Abstract: In the Constitutional Amendment 2020, the Algerian constitutional founder created a new constitutional body represented by the Constitutional Court instead of the Constitutional Council, which was consecrated starting in 1989,this study aims to highlight the competences of the new constitutional body compared to Constitutional Council ,did it retrain the same competencies or grant it new competencies, and we reached through this research a set of result ,including the granting of the constitutional ruler a new jurisdiction that was not assingned to the constitutional court ,witch adjudicat the different between the authority’s
