الوساطة الجزائية كآلية لتحقيق العدالة الجنائية البديلة للأحداث الجانحين في التشريع الجزائري

Résumé: استحدث المشرع الجزائري الية الوساطة الجزائية لحل النزاعات الجزائية الناشئة عن جنوح الاحداث بموجب القانون رقم 15/12 الصادر في 15 جويلية 2015 المتعلق بحماية الطفل، وهو أسلوب يتماشى والتطور الحاصل في مجال العدالة الجنائية، ساعيا من خلال ذلك الى تبني العدالة التفاوضية او التصالحية والاتجاه الى العقوبات الرضائية في حل النزاعات بعيدا عن العقوبات الزجرية المطبقة سابقا، لاسيما اذا تعلق الامر بالطفل الجانح ، ذلك ان الوساطة تعتبر احدى اهم اليات نظام العدالة الرضائية كونها تسعى للإصلاح اكثر من تسليط العقوبة وهذا تماشيا مع ما تسمو اليه السياسة الجنائية الحديثة . The Algerian legislator has set up a penal mediation mechanism to resolve penal disputes arising from juvenile delinquency by virtue of law n ° 12/15 of July 15, 2015 relating to child protection, a method consistent with the 'evolution in the field of criminal justice, seeking through the adoption of a negotiation or restorative justice and moving towards consensual sanctions in the resolution of disputes far from the coercive sanctions previously applied, especially if it concerns the child offender, because mediation is considered one of the most important mechanisms of the consensual justice system, because it aims at reform rather than imposing punishment, and this corresponds to what modern penal policy transcends.
