خيار الوساطة الجزائية لحماية الطفل الجانح بين سياسة التأهيل وجبر الضرر/ The Penal Mediation Option For The Protection Of Delinquent Children Between Rehabililitation Policy And Reparation

Résumé: لقد أصبحت السياسة الجنائية تعتمد على الوسائل البديلة لحل النزاعات، إذ تمثل الوساطة الجزائية نموذجا جديدا للعدالة الجنائية الحديثة التي قوامها الرضا الصادر عن إرادات متعددة والتي تقود عادة إلى إنهاء النزاع. وسعيا من المشرع الجزائري في سبيل توفير الحماية اللازمة للطفل الجانح فقد تبنى إجراء الوساطة الجزائية بموجب قانون حماية الطفل، وذلك في سبيل فتح قناة تواصلية بين الطفل الجانح والضحية وتحويل حالة التصادم القائم بينهما من خلال قيام الطفل بتعويض الضحية في مقابل تخلي هذا الأخير عن أحقية تحريك الدعوى العمومية، لتسهم بذلك الوساطة الجزائية في تأهيل الطفل الجانح ليكون فردا صالحا في المجتمع. Criminal policy has become dependent on alternative means of conflict resolution. Penal mediation is a new model of modern criminal justice, based on the consent of multiple wills, which usually leads to an end to conflict. In an effort to provide the necessary protection to the delinquent child, the Algerian legislature has adopted a procedure of penal mediation under the Child Protection Act in order to open a channel of communication between the delinquent child and the victim and to transform the state of collision between them by compensating the victim in return for the latter's renunciation of the right to initiate public proceedings, thereby contributing to the rehabilitation of criminal mediation Delinquent child to be a good member of society.
