Résumé: يتناول هذا البحث أحكام إثبات النسب ونفيه على ضوء الاستكشافات الطبية في قانون الأحوال الشخصية العراقي مقارنة بالشريعة الإسلامية والتشريعات العربية. والغرض منه هو التعرّف على مدى استيعاب القانون العراقي للأحكام المذكورة وبيان موقف القضاء العراقي منها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي والمقارن. واختتم البحث بنتائج وهي: أن القانون العراقي يعتريه ثغرة تشريعية كبيرة فيما يخص هذه الأحكام بحيث أن النصوص القانونية الحالية غير قادرة على تغطيتها، ونتيجة لذلك كان موقف القضاء متذبذباً إذ لم يستقر على اتجاه معيّن. This research deals with the provisions of proving and denying lineage in the light of medical explorations in Iraqi personal status law comparing to Islamic law and Arabic legislation. Its purpose is to identify the extent to which the Iraqi law includes the aforementioned provisions and to show the position of the Iraqi Judiciary regarding them. In order to achieve that, the researcher used the inductive analytical and comparative method. The research was concluded with results, which are: The Iraqi law has a major legislative loophole with regard to these provisions, as the current legal texts are unable to cover them. As a result, the position of the judiciary was vacillating, as it did not settle on a specific trend.
