أحكام النسب دراسة مقارنة بين القانون العراقي و(الشريعة الإسلامية، التشريعات العربية) The Provisions Of Lineage A Comparative Study Between Iraqi Law And (islamic Law & Arabic Legislation)

Résumé: يتناول هذا البحث أحكام النسب في قانون الأحوال الشخصية العراقي مقارنة بالشريعة الإسلامية والتشريعات العربية. والغرض منه هو التعرّف على مدى استيعاب القانون العراقي للأحكام الشرعية للنسب وبيان موقف القضاء العراقي منها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي والمقارن. واختتم البحث بنتائج وهي: أن القانون العراقي يعتريه ثغرة تشريعية كبيرة فيما يخص أحكام النسب بحيث أن النصوص القانونية الحالية غير قادرة على تغطيتها، ورغم ذلك جاء موقف القضاء مناسباً وذلك بتبنّيه رأي جمهور فقهاء المسلمين بخصوص الأحكام التي لم تتناولها القانون. This research deals with the provisions of lineage in Iraqi personal status law comparing to Islamic law and Arabic legislation. Its purpose is to identify the extent to which the Iraqi law includes the Sharia provisions of lineage and showing the stand of the Iraqi judiciary about it. In order to achieve this, the researcher used the inductive analytical and comparative method. The research was concluded with results, which are: The Iraqi law has a major legislative loophole with regard to the provisions of lineage, as the current legal texts are unable to cover them. Despite this, the judiciary’s stand was appropriate by adopting the opinion of the majority of Muslim jurists regarding the provisions that were not covered by the law.
