القيمة المعيارية للأمن القانوني وعلاقته بالديمقراطية التوافقية

Résumé: لقد أخذ الأمن القانوني مكانة رائدة بين المواضيع الأكثر طرحاً في السنوات الأخيرة، فإن كان وجود القانون بمفهومه الواسع سمة تبرز من خلالها القيمة الموضوعية للدولة، فإن بلوغ الأمن القانوني هو نهج تعتليه نظم الديمقراطية التوافقية، في علاقة بين هاذين الأخيرين تأكدت أهميتها بالعديد من المعايير، فكان الهدف في هذه الورقة البحثية مركزا حول توضيح التداخل بين ما تسعى الديمقراطية التوافقية الوصول إليه بتفعيل النقض المتبادل، والائتلاف الشامل، وما حققه الأمن القانوني من حماية للتوقع المشروع والوصول إلى القانون، لنخلص إلى نتيجة مفادها أن التداخل السياسي والقانوني أوضحته الديمقراطية التوافقية بتحقيق أعلى قدر من التعايش السلمي بين الطوائف المتعددة، والاتجاهات السياسية المتعارضة، ليشكل الأمن القانوني الآلية التي عززت لذلك الاختلاف ببلوغ أعلى متطلبات الاستمرارية.
