الإبلاغ عن جريمة تهريب المهاجرين في التشريع الوطني بين الواجب القانوني وضرورات تفعيله

Résumé: الملخص: فرض المشرع بموجب القانون رقم 09-01 المؤرخ في 25 فيفري 2009، المعدل والمتمم لقانون العقوبات، واجب الإبلاغ عن جريمة تهريب المهاجرين على كل شخص علم بوقوعها أو الشروع فيها وذلك تحت طائلة العقاب؛ غير أنه كثيرا ما يمتنع الأشخاص عن أداء هذا الواجب، وذلك خوفا من تعرّضهم للانتقام من المهربين، مما يؤدي إلى إعاقة السير الحسن للعدالة؛ الأمر الذي يستدعي ضرورة إيجاد آليات قانونية لتفعيله، وهو ما تهدف إليه هذه الدراسة. Abstract: By virtue of law n ° 09-01 of February 25, 2009, amending and supplementing the Penal Code, the legislator imposed the duty to denounce the offense of smuggling of migrants on any person who was aware of it. or who would have tried under penalty of sanction. However, people often refrain from fulfilling this duty, fearing reprisals from the smugglers, which would hamper the proper conduct of justice. This calls for the need to create legal mechanisms to activate it.
