دور منظمة العمل الدولية في حماية العمال المهاجرين

Résumé: تهدف هذه الدراسة إلى معرفة الإطار القانوني المنظم لتشغيل العمال المهاجرين على مستوى منظمة العمل الدولية و مدى فعّالية آليات عمل هذه المنظمة في حماية حقوقهم، من خلال الكشف عن مصدر الحقوق المعترف بها لكل المهاجرين ، إلى جانب الوصف الدقيق لواقع الممارسة الدولية في مجال حماية حقوق العمال المهاجرين. تم التوصل إلى أن فعّالية الاتفاقيات الدولية يتوقف على مدى المصادقة عليها وفعّالية آليات الرقابة التي تنص عليها، فرغم وجود ضمانات حماية العمال المهاجرين إلاّ أن فاعليتها تبقى نسبية . This study aims to know the legal framework governing the employment of migrant workers at the level of the International Labor Organization and the effectiveness of the mechanisms of this organization’s work in protecting their rights through on to reveal the source of the recognized rights of migrants, as well as an accurate descriptive approach to the reality of international practice in the field of protecting the rights of migrant workers. It was concluded that the effectiveness of international conventions depends on the extent of their ratification and the effectiveness of the control mechanisms they stipulate. Despite the existence of guarantees to protect migrant workers, their effectiveness remains relative.
