التحقيق التأديبي في الوظيفة العامة و دوره في مكافحة الفساد

Résumé: التحقيق الإداري يحتل مكانة بالغة الأهمية عند تحريك مسؤولية الموظف التأديبيـة و الغرض من هذا البحث هو تسليط الضوء على العلاقة بين التحقيق التأديبي و مكافحة الفساد، فالتحقيق التأديبي الاتجاه الحديث للإدارة فهو لا يمثل في ذاته غاية تتوخاها الإدارة لتوقيع الجزاء فقط، بل هو وسيلة يراد من خلالها كشف مواطن الخلل في المرفق العام، كما يُعد أداة فعالة لاستجلاء الحقيقة بإثبات أو نفي ارتكاب الموظف للخطأ التأديبي المنسوب إليه كما يعتبر سبيل الإدارة في تقرير المسؤولية التأديبية للموظف. التحقيق التأديبي يهتم و يتشعب في تفاصيل لا يصل إليها التحقيق الجزائي، لان التحقيق التأديبي لا يحكمه تنظيم متكامل و بالتالي لا يقوم فقط على أُطر قانونية و إنما كذلك على أُطر إدارية و تنظيمية، مما يساعده على التحقيق في وقائع الفساد التي يرتكبها الموظف من خلال الكشف عن الفتور في القوانين و اللوائح التي تنظم مهام الموظف، مما يؤدي إلى الكشف عن جرائم الفساد، بالإضافة المحافظة على المال العام، مع الحد من انعدام الالتزام بالقوانين و الوصول إلى خدمة عامة راقية. كلمات مفتاحية: التحقيق التأديبي، المحقق التأديبي، الفساد، الموظف العام. Abstract The administrative investigation occupies a very important place in the displacement of the disciplinary responsibility of the employee. The purpose of this research is to shed light on the relationship between the disciplinary investigation and the fight against corruption. It is also considered as a effective tool to clarify the truth by proving or denying that the employee committed the disciplinary error attributed to him, and it is also considered as the way management determines the disciplinary responsibility of the employee. The disciplinary investigation concerns and branches off into details that the criminal investigation does not reach, because the disciplinary investigation is not governed by an integrated organization and is therefore based not only on legal frameworks, but also on administrative and organizational executives, which helps to investigate acts of corruption committed by the employee through disclosure On the apathy in the laws and regulations that
