أحكام الضرر المعنوي في عقيدة القضاء الإداري Provisions Of Moral Damage In The Doctrine Of The Administrative Judiciary

Résumé: نتناول في هذه الدراسة أحكام الضرر المعنوي في عقيدة القضاء الإداري، وذلك بتسليط الضوء على مفهوم الضرر المعنوي، وكذا البحث في موقف القضاء الإداري سواء في الجزائر أو القضاء المقارن إزاء مسألة التعويض عن هذا النوع من الضرر. توصلنا إلى أن الضرر المعنوي يكمن أساسا في ضرر يمس مصالح غير مالية للمضرور، أما بخصوص مسألة التعويض عنه، فإن القضاء الإداري يتجه حاليا إلى الحكم بالتعويض عن الضرر المعنوي. In this study, we examine the provisions of non-pecuniary damage in the doctrine of administrative justice, highlighting the notion of non-pecuniary damage and discussing the position of the Algerian judiciary and comparative justice in reparation of this type. of damage. We have concluded that the non-pecuniary damage relates mainly to the harm caused to the victim in the non-pecuniary interest. With regard to the issue of compensation, the administrative judiciary is currently entitled to compensate the non-pecuniary damage.
