تنفيذ الأحكام الجزائية وإشكالاته في التشريع الجزائري

Résumé: لقد تطورت المعاملة العقابية للمحكوم عليهم في ظل السياسة الجنائية المعاصرة بتغير غرض العقوبة من الردع والقسوة والإنتقام من الجاني إلى محاولة إصلاحه وتهذيبه وإعادة إدماجه في المجتمع. إن المشرع الجزائري وإقتناعا منه لمواكبة التطور الحاصل في مجال السياسة العقابية سعي إلى إعطاء أهمية لتنفيذ الأحكام الجزائية وذلك بإسناد هذه المهمة إلى النيابة العامة إضافة إلى ذلك أنه ألغي العقوبات التبعية وإدماجها في العقوبات التكميلية من خلال تعديل قانون العقوبات، كما خلق المشرع الجزائري أنظمة بديلة للعقوبة التكميلية من خلال تعديل قانون العقوبات، كما خلق المشرع الجزائري أنظمة بديلة للعقوبات وذلك لإصلاح الجاني وإعادة إدماجه في المجتمع، كما أنه حاول القضاء على مساوئ الحبس القصير المدة واستبدالها بعقوبة الغرامة، كما حاول الإستفادة من الجاني من خلال عقوبة العمل لنفع العام وكلها تعتبر إيجابيات توصل إليها المشرع الجزائري. كما أن هناك إشكالات تعترض تنفيذ الأحكام الجزائية وذلك إما بالتنفيذ بغير ما صدر به الحكم الجزائي أو تم ضياع السند التنفيذي إما من طرف الهيئة المنوطة بالتنفيذ أو من طرف صاحب الحق في المحكوم عليه الحقيقي وإما بالخطأ في التطبيق من طرف الهيئة المختصة وذلك لتشابه الأسماء والصفات، مما أثار إشكالية الهيئة المختصة في الفصل في الإشكال في التنفيذ أهي السلطة المصدرة للحكم أو سلطة أخرى؟ ويساهم في انقضاء العقوبة، إما يموت المنفذ عليه أو بإصدار عفو شامل، وإما بإلغاء الصفة الإجرامية على الفعل المجرم، وبه تنقضي العقوبة. الكلمات المفتاحية:المعاملة العقابية، الأحكام الجزائية، العقوبات التبعية.   Abstract: The punitive treatment of convicts has evolved in light of contemporary criminal policy by changing the purpose of punishment from deterrence, cruelty and revenge from the offender to an attempt to reform, discipline and reintegrate him into society. The Algerian legislator, convinced of him to keep pace with the development taking place in the field of penal policy, sought to give importance to the implementation of penal provisions by assigning this task to the Public Prosecution. In addition, he abolished accessory penalties and incorporated them into complementary penalties by amending the Penal Code, and the Algerian legislator created alternative systems for punishment. Complementary by amending the Penal Code. The Algerian legislator also created alternative systems of penalties in order to reform the offender and reintegrate him into society. He also tried to eliminate the disadvantages of short-term imprisonment and replace it with a fine penalty. He also tried to take advantage of the offender through the work penalty for the benefit of the public, all of which are considered positives that reach to the Algerian legislator. There are also problems that obstruct the implementation of the penal judgments, either by implementing other than what the penal judgment was issued for, or the executive document has been lost, either by the body in charge of the execution or by the right holder in the real convict, or by mistake in the application by the competent authority, due to the similarity of names and qualities, What raised the problematic of the competent body in deciding the problem in implementation Is it the authority issuing the ruling or another authority? It contributes to the expiration of the penalty, either by the person who committed it dies or by issuing a comprehensive pardon, or by canceling the criminal character of the criminal act, and with it the penalty ends.
