الملاحقة كآلية للتحصيل الجبري في ظل قانون رقم 08/08
Résumé: لقد كفل المشرع الجزائري حماية قانونية لمستحقات الضمان الاجتماعي حيث يجعلها في المرتبة الثالثة بعد أجور العمال والخزينة العمومية. القانون خول لهذه الهيئات آليات وأساليب خاصة من أجل تحصيل مستحقاتها نظرا لتقاعس بعض المكلفين في مجال الضمان الاجتماعي في حالة اخلالهم وعدم الإيفاء بالتزاماتهم المنصوص عليها والمحددة قانونا (قانون رقم 83/14 المتعلق بالتزامات المكلفين في مجال الضمان الاجتماعي المعدل والمتمم بالقانون رقم 04/17 المؤرخ في 10/11/2004. The Algerian legislator has guaranteed legal protection for social security benefits, as it places it third after workers’ wages and the public treasury. The law authorizes these bodies to have special mechanisms and methods for the collection of their dues due to the failure of some of those charged with the field of social security in the event of their breach and failure to fulfill their obligations stipulated and legally defined (Law No 83/14 related to the obligations of those charged with the field of social security, amended and supplemented by Law No. 04/17 of 10/11/2004.
