إنقضاء الخصومة بغير حكم فيها في قانون الاجراءات المدنية والادارية

Résumé: ملخص : تنتهي الخصومة عادة بالحكم في موضوع الدعوى والحكم في الموضوع هو الغاية النهائية والنتيجة الطبيعية لإجراءات الخصومة ،فمن يرفع دعوى يرمي إلى الحصول على حقه وحمايته وهذه الحماية تتحقق عن طريق الحكم الذي يفصل في النزاع أو الاعتداء على الحق وقد يكون هذا الحكم لمصلحة المدعى أو ضد مصلحته على أن الخصومة قد لا تبلغ هذه الغاية وتنتهي قبل ذلك لأسباب مختلفة منها زوال الخصومة دونما حكم فاصل في موضوعها، حيث تحيد بالخصومة عوامل لا تؤدي بها إلى النهاية الطبيعية بل تؤدي لانقضائها بغير حكم فيها. Abstract : The dispute usually ends with the ruling on the subject matter of the case and the judgment on the subject is the ultimate goal and the natural outcome of the proceedings of the dispute. Whoever submits an action to obtain and protect his right is protected by a judgment that is settled in the dispute or an attack on the right. However, the rivalry may not reach this end and ends before that for various reasons, including the elimination of the dispute without a separate judgment on its subject, where the adversary is neutralizing factors that do not lead to the natural end, but lead to infraction without a ruling
