الاشكالات العملية لسقوط الخصومة في قانون الاجراءات المدنية والادارية

Résumé: ان سقوط الخصومة هو من الجزاءات المدنية التي نص عليها المشرع الجزائري في قانون الإجراءات المدنية القديم والجديد ، وهو جزاء يلحق الإجراءات وليس الحق ، ويحدث عندما يتماطل المدعي عن القيام بالإجراءات التي أمره بها القاضي او القانون والتي من شأنها أن تقدم القضية ، وعند تعديل المشرع الجزائري لقانون الإجراءات المدنية والإدارية بموجب القانون رقم 08-09 أحدث تغييرا في النصوص المنظمة لهذا الجزاء لاسيما فيما يتعلق ببداية حساب مدة السنتين وكذا الخصم الذي له حق التمسك به كما استحدث صورة جديدة للسقوط متعلقة بقرارات المحكمة العليا القاضية بالنقض والإحالة . The lapse of the litigation is one of the civil penalties stipulated by the Algerian legislator in the old and new civil procedure law, and it is a penalty attached to the procedures rather than the right, and it occurs when the plaintiff procrastinates from taking the procedures ordered by the judge or the law that would advance the case, and when the Algerian legislator is amended The Civil and Administrative Procedures Law under Law No. 09-08 brought about a change in the texts regulating this penalty, especially with regard to the beginning of the calculation of the two-year period, as well as the deduction that has the right to adhere to it, and also created a new picture of the failure related to the decisions of the Supreme Court ruling on cassation and referral.
