نظام هيئات الرقابة الشرعية في الجزائر

Résumé: تهدف الورقة البحثية إلى دراسة نظام الرقابة الشرعية على العمليات الصيرفة الإسلامية في الجزائر وخاصة في ظل توجه البنوك التقليدية العمومية بالخصوص نحو الصيرفة الإسلامية، وذلك من خلال معرفة الهيئات الشرعية المشرفة على عمليات الصيرفة الإسلامية. من خلال البحث تم التوصل أن القانون النقدي والمصرفي 23-09 نص على الهيئة الشرعية الوطنية للإفتاء للصناعة المالية الإسلامية، كذلك نص نظام رقم 20-02 المحدد للعمليات البنكية المتعلقة بالصيرفة الإسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية على هيئة الرقابة الشرعية، غير أنه لا يوجد نظام خاص بهذه الهيئة لتحديد صلاحياتها ومهامها وطرق اختيار أعضائها رغم أهميتها في إضفاء الصفة الشرعية على عمليات الصيرفة الإسلامية. The research paper aims to study the system of Shari'ah supervision over Islamic banking operations in Algeria, especially in light of the growing interest of public traditional banks in Islamic banking. The focus is on understanding the Shari'ah bodies supervising Islamic banking operations. The research concludes that the monetary and banking law 23-09 established the National Shari'ah Authority for Fatwas related to the Islamic financial industry. Additionally, Regulation No. 20-02, which outlines banking operations related to Islamic banking and the rules governing its practice by banks and financial institutions, specifies the Shari'ah supervisory body. However, there is no specific system for this body to define its powers, tasks, and methods for selecting its members, despite its importance in granting legitimacy to Islamic banking operations.
