دور المجلس الدستوري في السهر على صحة الإنتخابات الرئاسية على ضوء التعديل الدستوري لسنة 2016

Résumé: إذا كان الانتخاب يمثل الطريق الوحيد لتولي الرئيس منصب رئاسة الدولة في ظل النظام الجمهوري، فان طرق انتخاب رئيس الجمهورية تتعدد وتختلف باختلاف الدساتير، فمن هذه الدساتير ماجعلت هذا الانتخاب بواسطة الشعب، ومنها ماجعلته بواسطة البرلمان، وأخرى جعلته مشتركا بين البرلمان والشعب. اذ تعد مرحلة الترشح من المراحل الهامة التي تمر بها العملية الإنتخابية حيث يتولى المجلس الدستوري دورا هاما في السهر على صحة و شفافية و سلامة العملية الإنتخابية الرئاسية، وقد كفل التعديل الدستوري لسنة 2016، فضلا عن القانون العضوي للإنتخابات و النظام المحدد لقواعد عمل المجلس الدستوري لهذا الاخير صلاحيات واسعة في مجال مراقبة حرية الترشح للإنتخابات الرئاسية . If the election represents the only way for the president to assume the presidency of the state under the republican system, then the methods for electing the president of the republic are multiple and vary according to the different constitutions. The Constitutional Council plays an important role in ensuring the validity, transparency and integrity of the presidential election process. The constitutional amendment of 2016, as well as the organic law of the elections and the specific rules of the Constitutional Council The latter has wide powers in the field of monitoring the freedom to run for presidential elections.
