منــــــازعات التــــرشح فـــــي القانون العضوي 16 – 10 المتعلق بنظام الانتخابات

Résumé: إن منازعات الترشح تعد من أهم مواضيع العملية الانتخابية، باعتبارها ضامنة للعملية الانتخابية برمتها. والتى تطرح نفسها عند كل موعد انتخابي، وعلى هذا الأساس جاءت هذه المذكرة لتهتم بدراسة هذا الموضوع من جانب شروط الترشح، والتي تنطلق منازعة الترشح سواءا المـــحلية أو التشريعية او الرئاسية من مخالفتها وصدور القرار الإداري للجهة الفاحصة في ملف الترشح من منطلق ذلك، كما ترتكز هذه الدراسة حـــــول تحليل النصوص القانونية المتعلقة بمنـــــــازعة التــــــرشح الواردة ضمن القانون العضوي 16- 10 المتعلق بنظام الانتخابات من خلال مدى إمكانية اعطائه الضمانات الكافية للفرد المترشح من حمايات قانونيــــــــــة لتكريس حق التــــــرشح المكرس دســـــتوريا ليس بموجب النصوص القانونية فقط بل ميدانيا كذلك لاسيما عند اللجوء إلى القضاء . Election litigation is one of the major themes of the electoral process since it wholly regulates it. This question arises at the approach of every electoral event. On this basis, this dissertation aims at studying this subject in terms of conditions of eligibility to be a candidate. Local, legislative or presidential, election litigation occurs once rules are transgressed and the administrative decision is issued to the party examining the candidacy file. This paper relies on analyzing legal texts related to election litigation stipulated in the organic law N° 16-10 related to the electoral system, throughout adequate safeguards given to the candidate and relevant to legal protections, in order to devote the right to stand for election recognized in the constitution, not only in view of legal texts, but even on the ground notably when applying to the court
