الضمانات التشريعية لمبدأ عمومية الترشيح في الجزائر Legislative Guarantees For The Principle Of General Running In Algeria

Résumé: الملخص : تتناول هذه الدراسة التجسيد القانوني للمبدأ الدستوري الذي يعترف بحق الترشح للانتخابات، والذي يمنح السلطة التشريعية تنظيم جميع الاستحقاقات الانتخابية باستثناء الانتخابات الرئاسية التي تستمد شروطها مباشرة من الدستور. استوجب المشرع الجزائري في الناخب الراغب في الترشح ، بمقتضى القانون العضوي رقم 16 - 10 المتعلق بنظام الانتخابات، توفره على مجموعة من الشروط متعلقة بشخصه وأخرى خاصة بالعهدة الانتخابية تختلف باختلاف طبيعة الانتخاب، إلى جانب مجموعة من الشروط متعلقة بقائمة الترشح، وهي شروط لا تتعارض مع إرادة المؤسس الجزائري. Abstract: This study examines the legal embodiment of the constitutional principle that recognizes the right to stand for election, which gives the legislature the regulation of all electoral benefits except for the presidential elections that derive their conditions directly from the constitution. In the organic law No. 16-10 related to the election system, the Algerian legislator required a voter who wishes to run, to meet a set of conditions related to his person and others related to the electoral mandate that differ according to the nature of the election, along with a set of conditions related to the candidate list, which are not inconsistent With the will of the Algerian founder.
