النصوص القانونية الخاضعة لرقابة الدفع بعدم الدستورية بين التوسيع والتضييق Legal Texts Subject To The Exception Of Unconstitutionality Between Expansion And Restrictions

Résumé: يهدف هذا المقال إلى دراسة النصوص القانونية الخاضعة لرقابة الدفع بعدم الدستورية. ومن خلال الدراسة المقارنة والدفوع بعدم الدستورية المحالة على المجلس الدستوري الجزائري، تم التوصل إلى نتائج أهمها: ضرورة تعديل الدستور الحالي والقانون العضوي الذي يحدد شروط الدفع بعدم الدستورية والأخذ بالاتجاه الموسع للدفع بحيث يكون الحق في الدفع لكل شخص طبيعي أو معنوي وكذلك للقاضي من تلقاء نفسه، وأن يكون الدفع ضد أي نص ينتهك الدستور، وليس فقط ضد الحكم التشريعي الذي ينتهك الحقوق والحريات، وأن يكون الدفع في مواجهة كل النصوص القانونية بما فيها القوانين العادية والأوامر والتنظيمات. This article aims to study texts subject to the exception of unconstitutionality. And through the comparative study and the defenses referred to the Algerian Constitutional Council, the most important results were reached: the necessity of amending the current constitution and the organic law that defines the conditions of the exception of unconstitutionality, adopting the expanded tendency to push for unconstitutionality so that the right to do so for every natural or legal person, as well as for the judge, and to be challenged against any text that violates the constitution, including ordinary laws, ordinances and regulations.
