المحاكمة الجزائية عن بعد ورهان ضمانات المحاكمة العادلة في ظل الأمر 20/04

Résumé: ملخص: لقد أدى انتشار فيروس كورونا المستجد إلى تعطيل المحاكمات الجزائية ،الأمر الذي دفع بالجزائر إلى تفعيل آلية التقاضي عن بعد، وذلك حماية للأمن القضائي للأشخاص من خلال توفير محاكمة عادلة في أجل معقول، ومن جهة أخرى تعزيزا للأمن الصحي للسجناء وكل المتدخلين القضائيين، وهذا كله في إطار من الشرعية الإجرائية، إلا أن هذا التحول من الطابع التقليدي للمحاكمة الجزائية إلى المحاكمة عن بعد أثار جدلا كبيرا من حيث مدى توافره على ضمانات المحاكمة العادلة. Abstract: The spread of the new Corona virus has led to the disruption of criminal trials, which prompted Algeria to activate the remote litigation mechanism, in order to protect the judicial security of people by providing a fair trial within a reasonable time, and on the other hand, to enhance the health security of prisoners and all judicial interventions, and all this in A framework of procedural legality. However, this shift from the traditional nature of criminal trial to remote trial has sparked great controversy in terms of the availability of fair trial guarantees.
